VisiConnect is a product of Disruptive Kingdom Ministries Trust, a 508(c)(1)(A) faith-based organization.

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Disruptive Kingdom Ministries Trust ("DKM," "we," "us," or "our"), governing your access to and use of our website and VisiConnect church visitor management platform (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use our Services.

2. Definitions
- "Services" means the Disruptive Kingdom Ministries Trust website and VisiConnect platform
- "VisiConnect" means our church visitor management system
- "Account" means a registered user account for accessing Services
- "Church User" means a church, ministry, or religious organization using VisiConnect
- "End User" means an individual visitor, member, or attendee whose information is managed
- "Content" means any information, data, text, images, or materials submitted to the Services
- "Subscription" means a paid or free plan for access to VisiConnect
3. Eligibility
3.1 Age Requirements
You must be at least 18 years of age to create an Account. By using our Services, you represent that you are 18 or older or that you are a parent or legal guardian who has authorized use by a minor.
3.2 Organizational Accounts
Church Users must be duly organized religious organizations with lawful authority to use VisiConnect and to collect and manage personal information of their members, visitors, and attendees.
4. Account Registration and Security
4.1 Account Creation
You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and all activity under your Account. Immediately notify us of any unauthorized access.
5. Use of Services
5.1 Permitted Uses
You may use our Services to:
- Manage church visitor, member, and attendee records
- Track service attendance and engagement
- Coordinate ministry follow-up and outreach communications
- Facilitate small group and event management
- Access analytics related to your congregation's engagement
5.2 Prohibited Uses
You agree not to use our Services to:
- Violate any applicable federal, state, local, or international law or regulation
- Collect personal information without proper notice, consent, or legal basis
- Discriminate against individuals based on protected characteristics
- Harass, intimidate, threaten, or harm any individual
- Send unsolicited bulk messages without proper consent
- Impersonate any person or entity
- Infringe any patent, trademark, copyright, or other proprietary rights
- Introduce viruses, malware, or other harmful code
- Attempt unauthorized access to any portion of the Services
- Systematically extract data without prior written authorization
5.3 VisiConnect Administrator Responsibilities
Church Users accessing VisiConnect as administrators agree to:
- Use collected personal data only for legitimate ministry purposes
- Comply with all applicable privacy laws (GDPR, CCPA)
- Obtain all necessary consents from End Users before collecting their personal information
- Maintain appropriate security for administrator credentials
- Promptly report any data breaches or security incidents
6. VisiConnect Subscriptions
6.1 Plans and Pricing
Plan details and pricing are described on our Pricing page and may be updated from time to time.
6.2 Billing
Subscriptions are billed in advance monthly or annually. All fees are non-refundable except as required by law.
6.3 Cancellation
You may cancel your subscription at any time through Account settings or by contacting us. Cancellation takes effect at the end of the then-current billing period.
7. Intellectual Property
7.1 Our Property
Disruptive Kingdom Ministries Trust owns all intellectual property rights in the Services, including software, designs, logos, trademarks, text, and documentation.
7.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms and your subscription plan.
8. Privacy and Data Protection
Your use of the Services is governed by our Privacy Policy.
For VisiConnect:
- Church Users act as Data Controllers with respect to End User personal data
- Disruptive Kingdom Ministries Trust acts as a Data Processor
9. Third-Party Services
Our Services may integrate with or link to third-party services. We do not control and are not responsible for the content, privacy practices, or terms of third-party services.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
10.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DISRUPTIVE KINGDOM MINISTRIES TRUST SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $1,000.00, WHICHEVER IS GREATER. NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD.
11. Indemnification
You agree to indemnify, defend, and hold harmless Disruptive Kingdom Ministries Trust from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by the laws of the United States and the State applicable to Disruptive Kingdom Ministries' principal place of operation.
12.2 Arbitration
Any dispute not resolved informally within 30 days shall be resolved by binding arbitration in accordance with AAA Commercial Arbitration Rules.
12.3 Class Action Waiver
YOU AND DKM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.
13. Religious Mission Statement
Disruptive Kingdom Ministries is a faith-based organization. We reserve the right to operate consistent with our religious values and mission. Nothing in these Terms limits our exercise of our rights as a religious organization under applicable law.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms with a new effective date and sending email notification to registered users.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement.
- Severability: If any provision is found invalid, that provision shall be limited to the minimum extent necessary.
- Assignment: You may not assign your rights without our prior written consent.
- Force Majeure: Neither party shall be liable for delays from causes beyond reasonable control.
